BATTLE SPIRITS SAGA GRAND OPEN TOURNAMENT OFFICIAL TERMS AND CONDITIONS

These Battle Spirits Saga Tournament Official Terms and Conditions (the “Terms and Conditions”) govern your participation in this organized play event for the Battle Spirits Saga (“BSS”) trading card game of skill. Chance plays no part in determining the winner. By entering a BSS Grand Open Tournament (“Tournament”), in addition to these Terms and Conditions, you agree to be bound by the decisions of BANDAI CO., LTD. (“BANDAI”), and the Tournament Organizer (“TO”), including interpretations of the Tournament Rules Manual and Comprehensive Rules, and the judges who are contracted by the TO. The Tournament Rules Manual and Comprehensive Rules are known collectively as the “Official Rules”. In the event of a conflict among the Official Rules and the Terms and Conditions, these Terms and Conditions prevail. We reserve the right to change, revise and modify these Terms and Conditions, the Official Rules, and the Tournament, in our sole discretion, provided that but we will inform you of any changes either in writing or by public notice. Your continued participation in any manner in the Tournament after such change, revision or modification constitutes your acceptance of the same. The Tournament is hosted by the TO and supported by BANDAI. Event registration, ticketing, tournament management, prize distribution, cash prize payments, and customer service are handled directly by the TO. BANDAI does not collect any personal or private information from any participants, including any information required for cash prize payments. BANDAI does not directly pay cash prize payments to participants.

THE TERMS AND CONDITIONS CONTAIN A MANDATORY ARBITRATION PROVISION IN SECTION 6 WHICH LIMITS YOUR AND BANDAI AND/OR THE TOURNAMENT ORGANIZER’S ABILITY TO LITIGATE CLAIMS AS WELL AS A LIMITATION OF LIABILITY WHICH LIMITS THE LIABILTIY OF THIRD PARTIES, BANDAI ENTITIES, AGENTS, AND ITS FAMILY OF COMPANIES.

You are not required to be a resident or citizen of the country where the Tournament is held to participate, but you must follow all applicable local laws. Employees of BANDAI and/or the TO’s household or family members are not eligible. Individuals who have been disqualified or barred from participating in events by BANDAI and/or the TO are also not eligible. Any Tournament official associated with or working a Tournament may not play in that Tournament.

  1. Eligibility for Monetary Rewards. If a winner is eligible to receive a cash prize, the TO will notify the winner promptly at the Tournament venue to ensure the winner provides accurate payment details. If a winner does not provide accurate payment details within thirty (30) days of prize notification (the “Notification Window”), the TO reserves the right to rescind the prize notification, and the individual will forfeit the cash prize. The TO will make payment to the winner within thirty (30) days of receiving payment details, but may be unable to make payment of monetary prizes if a winner fails to provide the necessary or accurate payment information within the Notification Window. Prizes may not be substituted, assigned, transferred, or redeemed for cash (if not a cash prize) and are for personal use only. However, the TO reserves the right to the extent permitted by law, to substitute a prize (or portion thereof) with one of comparable or greater value in the event that the originally advertised prize becomes unavailable for any reason, in the TO’s sole discretion. The Tournament requires each player to exercise skill in order to ultimately become a winner.

  2. Taxes. Prizes are void where prohibited or restricted. Local, state, federal or provincial taxes, including but not limited to, VAT, GST or income tax associated with the receipt or use of any prize, are the sole responsibility of the winner. Unless the TO is required by winner’s jurisdiction of residence to withhold and pay the income tax withholding amount levied against the applicable prize awarded, the winner in whose name the prize is awarded will be responsible for all taxes (income and withholding) associated with acceptance and use of the prize. Such individual should consult with their tax advisor. 2. General Conditions. The Tournament is subject to all applicable federal, provincial, state, and local laws. These Terms and Conditions and the Official Rules may be translated into other languages. In the event of any conflict or inconsistency between any translated version of these Terms and Conditions or Official Rules and the English version of these rules, the English version shall prevail, govern and control. Except official tournament invitations by BANDAI and/or the TO, entry into a BSS Tournament does not constitute entry into any other tournament, competition, contest or sweepstakes potentially conducted by BANDAI and/or the TO.
  3. Questions or Concerns. If you have any questions or concerns about the Tournament or actions of players, please contact your Tournament’s TO directly. 11 Player Skill, Tournament Structure, and Prizing Player skill is required to build a competitive 50 card deck with strengths and weaknesses from a card pool that all players have access to. The exercise of skill is the overall predominant factor in determining a winner, and competitive players must accurately evaluate the strengths and

6

weaknesses of their deck, hand, and opponent’s deck and strategy in order to overcome elements such as a randomly dealt starting hand and determine the outcome of a match. Accounting for and managing variance in you and your opponents’ hand or deck requires knowledge of game rules, types of cards, experience, and acute decision-making skills. Players may earn prize money listed in Appendix A as a result of their skills and final ranking in a Tournament as outlined in the Tournament Rules Manual. In addition to prize money, players may earn promotional items including but not limited to, cards or card game accessories such as deck cases, card sleeves, and playmats. These promotional items have no commercial value and are not for sale. The TO reserves the right to withhold distribution of promotional items if player does not make their best efforts to finish a minimum of two (2) game rounds, or if player attempts to collect promotional items without participating in any rounds. Prize money is to be paid by the TO to the winner in USD. Winners are responsible to bear any currency conversion, transfer, or banking fees incurred upon receipt of prize money. Players should be aware of and must accept potential fluctuations in exchange rates in the period from the payment issuance, event date, and receipt by the player.
